Who is a Company Secretary in Practice or as popularly known as Practising Company Secretary (PCS)?
India has developed a field of professional practice called Practising Company Secretaries (PCS). Unlike what the name may suggest, PCS render a variety of professional services, though centered around corporate laws in several spheres, for example, FEMA, Company Law, Listed Company compliance etc, services of PCS are mandatory in the law.
PCSs are regulated by the Institute of Company Secretaries of India (ICSI), a premier national professional body set up under an act of Parliament, the Company Secretaries Act, 1980. The educational background, knowledge, training, and exposure that a Company Secretary acquires makes him/her a versatile professional capable of rendering a wide range of services to companies of all sizes, other commercial and industrial organisations, small scale units, firms, etc. on retainer-ship or assignment basis. The plethora of services, which a Practising Company Secretary can render varies from Setting up of a Business to its winding up and all the Compliance services which a corporate requires during its lifespan, be it issuance of shares on Demat, FEMA Compliance, appearing before the various quasi-judicial authorities, issuance of certificates under various regulation etc.
